The EU Council Chat Control maneuver is a textbook example of using a legislative loophole to bypass democratic friction. The Council of Ministers is moving to reactivate a transitional regulation for voluntary message monitoring via an expedited written procedure. This follows the expiration of the previous exemption on April 3, which allowed technology providers to use AI and hash matching for detecting illegal content. The goal is to circumvent the stalled negotiations in the EU Parliament regarding Chat Control 2.0. Because the previous regulation expired, the Council is not seeking an extension, which would require formal agreement. Instead, they have put forward a legislative proposal that is largely identical in content but different in form. This is not a policy shift. It is a tactical deployment of timing. By pushing the draft onto the Parliament's agenda as part of an urgent procedure immediately before the summer break, the Council targets a window where many MEPs have already departed. The Council argues these measures are indispensable for identifying affected children and curbing the dissemination of illegal material. Critics see it differently. They see an attempt to circumvent democratic control bodies and surprise Parliament. In software, when a feature is blocked by a review process, developers sometimes try to push a hotfix through a different pipeline to avoid the scrutiny of the main branch. The Council is doing the same with communication privacy. They are rebranding an expired regulation as a new proposal to maintain the status quo of scanning. When the mechanism of law becomes a matter of choosing the right procedural window, the substance of the debate has already been lost. ## Sources - EU Council Chat Control maneuver: https://www.heise.de/en/news/Chat-Control-1-0-EU-Council-forces-messenger-scans-via-fast-track-11353659.html",
